Cybersecurity: Software Company Affected by Ransomware Attack On August 4, the business software and services provider, Advanced announced a disruption on their system. Authorities later acknowledged that the cybersecurity threat was a result of a ransomware attack. There were five systems mainly affected which include Adastra (111 call handlers and GP records), Caresys (care homes), Staffplan (care organizations), Odyssey (clinical decision making), CareNotes (mental health trust patient records), and eFinancials (a public sector financial management system.) According to the threat intelligence provided to the company, UK authorities and expert advisors classified what happened as purely financially motivated. To this date, the results of the investigation have not identified whether sensitive data is at risk but more information about potential data access will be available in the upcoming weeks. Privacy: Google Fined $60 Million for Misleading Android Users Google has agreed to pay a $60 million fine after a court ruling by the Australian federal court. Last year, the Australian Competition and Consumer Commission (ACCC) accused the tech company of misleading 1.3 million Google accounts by collecting and usage of their personal location data. The case revolved around the ‘Location History’ setting which is available for Android users and was represented as the only setting responsible for collecting user data. However, it was found out that another account setting, ‘Web and App Activity, has the same function and was automatically turned on which was already fixed in 2018. Google fixed this in 2018 and said that has instilled a policy that their apps now have to request approval for tracking background location for it to be available on the Play Store. What do we do? Cybersecurity: New York Becomes First State to Require Cybersecurity Training for Attorneys The State of New York, the first in the U.S., now requires attorneys to take a one-hour of continuing legal education (CLE) under the new category, "Cybersecurity, Privacy, and Data Protection. The mandatory training will count toward the 32-hour CLE requirement for new lawyers in their first two years after admission to the bar. Other lawyers, can apply for the credit on their 24-hour biennial CLE requirement. Under the new requirement, attorneys need to complete one CLE credit, which has two parts: Ethics- Ethical obligations on the protection of electronic data and communication. General – Technological aspect of protecting client and law office communications and applicable laws relating to cybersecurity, privacy, and data protection. The adoption was on June 10, 2022, and this will take effect starting on July 1, 2023. Report: Corporate Legal Provider Counts Remain Low LegalVIEW Insights Volume 1 from Wolters Kluwer reports that corporate legal departments, regardless of size, have still been seriously impacted by the effects of the pandemic on the economy. The number of actively used law firms and service providers is continuously low and has not yet recovered. Data Breach: T-Mobile Agreed to Pay a Total of $500 Million to Settle Class-Action Lawsuit After the massive data breach in 2021 that victimized 76.6 million customers, T-Mobile has agreed to pay a total of $500 million to settle the class-action lawsuit. In a proposed agreement, released on July 22, 2022, T-Mobile will pay $350 million fund will be for the legal fees, lawyers, and the affected persons. The remaining $150 million is agreed to be for the improvement of the company’s “data security and related technology in 2022 and 2023." Additionally, according to the document the telecommunications giant denied the allegations that it failed in its role to protect the customer’s information which resulted in violations of state consumer laws. In August 2021, T-Mobile announced that they were a victim of a third-party data breach. Hackers were able to get personal information such as names, social security numbers, addresses, and driver's license information. Regulation: American Data Privacy and Protection Passed by House Committee On July 20, 2022, the U.S. House of Representatives Committee on Energy and Commerce approved H.R. 8152, or the American Data Privacy and Protection Act (ADPPA). The comprehensive federal data privacy bill is headed to the House floor for a vote. The Committee considered and agreed to a number of amendments including: H.R. 5313 or Reese’s Law - A bill protecting "children and other consumers against hazards associated with the accidental ingestion of button cell or coin batteries" H.R. 8152 or the American Data Privacy and Protection Act H.R. 3962 – “The Securing and Enabling Commerce Using Remote and Electronic Notarization Act of 2021” Before the enactment of the ADPPA, it will need the approval of the senate and it will take 180 days after enactment. Even if this bill will be passed or not, it is evident that this is a start for lawmakers to continue to protect the privacy of US citizens. July 25, 2022 News: £27 Million Worth of Crypto Seized by UK’s National Crime Agency Institutions and organizations that are involved in cryptocurrency need to be wiser in handling it since an annual report from the UK’s National Crime Agency (NCA), showed that £26.9 million ($32.4 million) worth of cryptocurrency from the past year has been seized. The NCA is tasked to investigate organized crimes, cybercrime, and economic crime. According to the report, the agency targeted cash-based and high-end money laundering that impacted the UK and the main vulnerabilities criminals exploited. Despite its volatility and susceptibility to digital fraud and theft. Many US Law firms, including Big Law, have been accepting crypto payments. An opinion from the District of Columbia Bar Legal Ethics Committee provided terms for agreeing on payment from clients. This includes: A clear explanation of how the client will be billed. July 18, 2022 Regulations: Progress of AI Legislations in the US Artificial Intelligence (AI) will continue to evolve and make groundbreaking progress across all industries. In legal technology, a growing number of AI applications and software are being in demand which alters how the legal industry does its work. In the US, several government agencies like the Department of Commerce (DoC), the Federal Trade Commission (FTC), the E.U.-U.S. Trade and Technology Council (TTC), and the National Security Commission on Artificial Intelligence (NSCAI) are starting to create a framework to its regulation. Below are existing developments related to AI regulation in the U.S: Under the National AI Initiative Act of 2020, the National Artificial Intelligence Advisory Committee (NAIAC) was formed to "advise the President and other federal agencies on a range of issues related to artificial intelligence (AI)". A memo was released by FTC declaring that they are vigilant on biases of the algorithms. TTC released a joint statement on its commitment to AI development and also its responsibility in OECD's Recommendations on AI. Currently, there is no federal law for AI but several states have laws related to its use: Illinois’ Artificial Intelligence Video Interview Act (AIVIA) obligates employers who use video interview technology for hiring to disclose the information and obtain consent from applicants. Colorado passed SB 21-169 protecting consumers against discriminatory practices of insurance companies on their AI systems. July 11, 2022 Canada’s Federal Privacy Legislation on AI According to Gartner by the end of 2022, the AI market will reach $62 billion. AI has integrated into our lives with the software people use daily and including governments using it in different sectors. With its involvement in policy making laws have been drafted to regulate it. Last year, the European Commission proposed the Artificial Intelligence Act which is expected to set a benchmark for government usage and provide protection from risks or negative consequences for individuals of AI. Following the EU, Canada has introduced Bill C-27 which includes the Artificial Intelligence and Data Act, a federal regulation that will involve private sector personal information protection practices. Below are the highlights of the proposed bill: Part 2 of The Personal Information Protection and Electronic Documents Act (PIPEDA) will be changed to "An Act to provide for the use of electronic means to communicate or record information or transactions," or the Electronic Documents Act. The Artificial Intelligence and Data Act will establish oversight in international and interprovincial trade and commerce in AI systems. An administrative tribunal will be created to oversee certain decisions made by the Privacy Commissioner of Canada and make orders for contraventions of the CPPA. If passed organizations that fail to comply will be fined up to 5% of global revenue or CA$25 million (the US $19 million), whichever is higher. CISA Accepting Public Comments on TIC 3.0 Cloud Use Case The Cybersecurity and Infrastructure Security Agency (CISA) has posted an advisory asking for the public’s input on the draft released by Trusted Internet Connections (TIC) program on its TIC 3.0 Cloud Use Case. According to CISA TIC 3.0, Cloud Use Case is meant to provide security on the network and multi-boundary security should be applied in cloud environments, it also focuses on deployments for Infrastructure-as-a-Service, Platform-as-a-Service, Software-as-a-Service, and Email-as-a-Service. July 4, 2023 Report: Thomson Reuters 2022 State of Corporate Legal Departments The pandemic has no doubt become a catalyst of change and transformation across all industries. Law firm Hagens Berman represented the Android app developers in the class-action lawsuit accusing the tech giant of anticompetitive policies governing the Google Play Store. According to the Hagens Berman team, Google excluded competing for app stores, this obligated the developers to pay the tech giant extremely high fees in violation of federal antitrust laws. Additionally, the agreement will bring a change to Google Play Store. App developers will now have to pay a 15% service fee on their first $1 million in annual revenues until at least May 25, 2025, which is a huge decrease from its current rate which is 30%. June 27,2022 Regulation: Carnival Fined by New York Regulators for Cybersecurity Violations International cruise line company, Carnival Corporation, was fined on Friday amounting to $5 million. New York state regulators found them violating cybersecurity laws after four security breaches spanning from 2019 to 2021. The incidents involved sensitive customer data which put them at risk. The State of New York's Department of Financial Services said that the company violated the regulation by failing to use multi-factor authentication which would make it harder for attackers to access its internal network. Carnival also failed to train its employees and failed to report a 2019 cybersecurity incident. On June 23, 2022, a $1.25 million settlement was reached with attorney generals of the 45 US states and the District of Columbia. Report: The Enterprise Legal Reputation Report The Enterprise Legal Reputation (ELR) Report is research concentrated on how the corporate legal department is perceived by employees. June 20, 2022 Compliance: New NY Privacy Law Took Effect New York privacy law on electronic monitoring of employee communications took effect on May 7, 2022. The newly passed legislation requires businesses that are in the state of New York to provide notice through a written notice or an electronic form to newly hired employees stating that their communications through telephone or electronic mail, internet access, and usage would be subject to monitoring. Employers should obtain the acknowledgment and should post the notice at the workplace so that current employees can easily view it anytime. First-time violators will need to pay a fine of $500, $1,000 for a second violation, and the following a fine would be $3,000. Privacy: The American Data Privacy and Protection Act Draft Released Continuing the momentum of state privacy laws from California, Colorado, Connecticut, Utah, and Virginia, a draft for a comprehensive privacy bill at the federal level, The American Data Privacy and Protection Act (ADPPA) was released two weeks ago. On June 14, 2022, a legislative hearing was held. The bill has bipartisan support from its sponsors including House Energy and Commerce Chair Frank Pallone, Cathy McMorris Rodgers, and Sen. Roger Wicker the Senate Commerce Committee held a legislative hearing that discussed it. The ADPPA aims to be the counterpart of the EU’s GDPR, and it also shares the best features of the California Consumer Privacy Act (CCPA). If passed, the bill would require limiting the collection, processing, and transfer of “covered data” to that which is “reasonably necessary, proportionate, and limited to” providing products or services to the individual. This would also provide American citizens additional rights to their data by giving them the choice to access, change or delete their data.
