    June 13, 2022 Data Breach: Judge Approves $63 Million for OPM Hack Victims One of the most controversial data breaches is coming to its conclusion after a seven-year legal battle in a newly released court order. U.S. District Judge Amy Berman Jackson gave preliminary approval for a $63 million settlement. Under the proposed settlement, victims who can prove that they suffered from financial losses due to the incident could receive at least $700 and with a maximum amount of $10,000. In June 2015 Office of Personnel Management announced that its personnel records had been targeted by foreign government-backed hackers. This resulted in a catastrophic breach of personal information including check forms, Social Security numbers, and fingerprint information.     June 6, 2022 Cybersecurity: Microsoft 0-day Flaw Last week after experts expressed concern about exploiting Microsoft Support Diagnostic Tool (MSDT) to remotely control affected devices, the tech giant released guidance for the Remote Control Execution (RCE) flaw or CVE-2022-3019. A day after US Cybersecurity and Infrastructure Security Agency (CISA) released a statement urging users to apply the necessary workaround and describing the issue as a "remote, unauthenticated attacker could exploit this vulnerability to take control of an affected system". According to security researchers, the vulnerability exists in all currently supported Windows versions and attackers are actively exploiting it through Microsoft Office versions 2013 through Office 2019, Office 2021, Office 365, and Office ProPlus. As of writing, there is no patch released yet but Microsoft recommends that the users that were affected should disable the MSDT URL. The company said that what they released "prevents troubleshooters being launched as links including links throughout the operating system". Privacy: Tim Hortons’ App Violated Laws Two years after the Office of the Privacy Commissioner of Canada (OPC) launched the investigation with federal privacy authorities in British Columbia, Quebec, and Alberta, they found the Coffee chain guilty of breaching privacy laws through its mobile app. The company's 3rd party service provider, the US company Radar Labs Inc. is a co-defendant in two of the lawsuits. In May 2019, the Tim Hortons has updated its app, and users were led to believe that it will only gather information while they are using it. However, in the commissioner's report, they said that the language in the contractual clauses was "vague and permissive," that Tim Hortons did not adequately inform customers about location tracking and there was no “meaningful consent.” From 2019 to 2020, with 4 million users the data collected was vast, the app collected location data every 2.5 to 6 minutes once it detects movement from the user. The company has agreed to delete all location data and to have third-party service providers do so as well, as per recommendations from the privacy authorities.     May 30, 2022 News: Facial Recognition Company Fined by ICO UK’s Information Commissioner’s Office (ICO) has fined the facial recognition database company, Clearview AI Inc. amounting to £ 7.5 million ($8 million). Clearview AI’s database consists of more than 20 billion facial images and data accumulated from publicly available information on the internet and social media platforms all over the world. Users have not consented to these and in many countries, this is a violation of privacy laws. An excerpt from U.K information Commissioner, John Edwards acknowledged how this act negatively affects everyone: “People expect that their personal information will be respected, regardless of where in the world their data is being used. That is why global companies need international enforcement. Working with colleagues around the world helped us take this action and protect people from such intrusive activity.” This is not the first time the company has faced lawsuits. In the US, Clearview has settled a lawsuit against American Civil Liberties Union. They were accused of breaching the Biometric Information Privacy Act (BIPA) which protects individuals’ biometric data by prohibiting its use without prior consent. Event: 2022 Women of Legal Tech Summit Last Wednesday, May 25, 2022, ABA’s 2022 Women of Legal Tech Summit held its virtual event.     May 23, 2022 Report: 2022 In house Legal Tech Report The 2022 In-house Legal Technology report was recently released. With almost 500 in-house lawyers and legal professionals, the report provides valuable insights on the current state of legal technology in corporate legal departments and emerging trends businesses have to watch out for. Key highlights of the report are listed below: 90% of legal teams currently have 3 or more software vendors. However, this also causes inefficiencies. Using separate platforms creates a disconnect in performing their tasks. 77% of in house teams spend over 1 hour every day jumping among different systems while 39% spend 3 hours or more. 85% of US respondents find a consolidated solution a better choice for them. 92% recognize that manual day-to-day tasks take a chunk of their time. They believe that this hinders them to work on high level tasks which affect business goals and slower delivery of services. News BackTrack: Paralegal Frauds Law Firm Three years have passed since paralegal, Paul Young, stole almost £500,000 ($619,340.00) from a UK-based law firm Berrymans Lace Mawer. He first joined the firm's office in Manchester in 2016 and then “took advantage of flaws” in BLM‘s system for over 3 years he made 116 payments into his personal bank account. Not until 2019 when his fraud activities were exposed when a line manager discovered £32,000 had been paid out by Aviva in a series of payments but the claimant’s solicitors confirmed that no payments were received. In 2020, the Solicitors Regulation Authority (SRA) handed the paralegal a Section 43 order which bans him from working for law firms. Event: Legal Leaders USA 2022 Happening this week, Reuters’ annual event Legal Leaders USA will run from May 23 to 24, 2022 at the New York Marriott at the Brooklyn Bridge. The event promised interactive roundtable workshops, editorial interviews, and a chance to network with leading law firms and legal tech companies.     May 16, 2022 NJ-based Law Firm sued Bank Sapiro Gottlieb & Kroll, a New Jersey-based law firm has filed a state lawsuit against TD Bank N.A. after it allegedly stole $200,000 from the firm’s attorney. According to the suit, a username and password were set up by the fraudsters that enabled them to snag $202,660 between July 6 and July 15, 2021. The firm’s partner, Lawrence Kroll, noticed the anomalies while checking the account status online and not until then did the law firm know what had happened. The law firm has sought reimbursements however, they were left disappointed as the bank has rejected their request. This action has resulted in a pushback as Sapiro Gottlieb & Kroll claim that the incident is a breach of “contractual obligations”.   • Press Release: InfiniGlobe’s Research Paper on Using AI in Legal Invoice Review

    May 5, 2022 NEWPORT BEACH, CA- InfiniGlobe Research Lab, a division of InfiniGlobe, has published “Detecting Anomalous Invoice Line Items in the Legal Case Lifecycle” (rev. 2021), a research on how Machine Learning models can be trained on historical and synthetic invoice data for detecting anomalous invoice line-items. The corporate legal industry processes billions of dollars invoices every year. Most legal invoices contain hundreds of line-items with detailed information. The opportunity for undetected discrepancies and the cost of the review is exponentially greater than in other industries, making this research particularly interesting to Legal Ops teams. Beyond its applied impact, this published research is a first peek into the opportunities that can reveal themselves when applying legal business data to leading machine learning models.     May 2, 2022 US Privacy Law: Connecticut Data Privacy Act On April 28, 2022, Senator James Maroney's SB-6, Connecticut Data Privacy Act (CTDPA), was passed by the Connecticut General Assembly. Its passing will strengthen data protection. The bill will take effect on July 1, 2023, which will give businesses to provide an option for consumers an opt-out preference signals for targeted advertising and sales by 2025. Governor Ned Lamont is set to sign it and if successful it would pick up the momentum of California, Virginia, Colorado, and Utah for having an individual privacy law for their residents. Microsoft 365 Users and Email Security Threats The rise of employees working outside their office has resulted in an alarming increase of email related security threats. A 2022 Osterman Report was released for businesses to have better security against these threats, with 226 organizations with Microsoft 365 users as respondents. Important highlights of the report are as follows: 89% of organizations have experienced one or more types of email breaches in the past year. For preventing threats, 76% said that they have used a third-party secure email gateway solution. Resolving email breaches is also one aspect that was looked into and on average a company spends 175 hours per attack. Email breaches cost US businesses $82,413 per year per 1,000 email users and UK companies $55,938 per 1,000 email users. More types of breaches are experienced, with a significant increase of ransomware breaches by 71% over the past three years while phishing breaches increased by 44%.     April 25, 2022 AI Regulation: AI Act and FTC On April 21, 2021, the European Commission proposed the AI Act – a bold step to regulate artificial intelligence solutions and technologies. Now a year has passed, and the debates are still ongoing with criticisms on its inclusion and discrimination tendencies on its passing. An overview of the act, a ban should be implemented on AI systems that: manipulate users through obscure techniques. exploit the fragility of vulnerable individuals leads to harmful consequences. are used by governments for social scoring. are used in publicly accessible platforms like remote biometric identification by law enforcement agencies. The US also eyes to regulate AI starting with a post from the Federal Trade Commission (FTC) followed by a proposed rule that “limit privacy abuses, and ensure that algorithmic decision-making does not result in unlawful discrimination.” If passed it will hopefully solve serious problems of discrimination, fraud, and related data misuse related to the use of AI. New Regulation: Digital Services Act Spearheading the campaign to fight against hate speech and disinformation, European Union and the European Parliament reached a political agreement for the Digital Services Act (DSA) during a recent trilogue negotiations on April 23, 2022. The landmark legislation will force big tech companies like Meta, Amazon and Google to prohibit targeted advertisements for children and report problems, and their non-compliance means large amounts of fines. With the increasing advancements in online intermediaries and platforms, the new regulation aims to level the field for companies and avoid big companies to become rule-makers. As users globally shift to digital services, expect more laws that safeguard privacy rights and cultivate innovation. Report: Impact of Legal Analytics More companies are maximizing data analytics in the crucial decision making process. With emerging legal tech platforms focusing on using big data, more legal ops teams that use it will increase. A report from Lex Machina captures how current legal professionals view legal analytics. The survey highlights the challenges organizations face in their adoption and how valuable it is to them. An increase from last year, 68% of law firms now use legal analytics, which can be a sign that the fear of automation is diminishing and the legal industry is discovering the benefits of technology. Below are some of the highlights: 98% of respondents who currently use Legal Analytics believe that Legal Analytics is valuable or somewhat valuable. 78% of the respondents who are non-users say the same. 74% of Legal Analytics users said that the key driver for the adoption is successful litigation. 63% answered that the next step would be Legal Analytics integration into organizational data.     April 18, 2022 Global Regulation: UK’s Operational Resilience As a result of the progressing reliance on third-party technology, the Bank of England’s Prudential Regulation Authority (PRA) issued a new Supervisory Statement (SS2/21). A year after it was issued the second statement, Operational Resilience: Impact Tolerances for Important Business (SS1/21), became effective on March 31, 2022. Under SS1/21, companies and firms in the UK now have a standard continuity plan. This requires them to build a plan on risks connected to critical business services. By doing so, the regulation aims for a better, robust and effective third-party management that protects both the institution and its clients. New Report: KPMG Fraud Outlook 2022 The latest report from KPMG shows that executives from different industries expect threats to worsen in 2022. Fraud, compliance, and cyber risk – the Threat Loop are the main challenges that businesses face. We live in a time where interconnectivity is the norm and most of the time it provides great convenience. However, it has its downsides, highly interconnected systems provide an opportunity for a disastrous domino effect. Other highlights include: 83% of the respondents have experienced a cyber-attack. 55% said that their company has been subjected to regulatory action. 43% answered that work from home policies have exacerbated the threats.   • Legal Tech Backtrack: Events Influencing 2022

    March 24, 2022 As everyone eases into 2022, we gradually see what this year has to offer. The goals that were set at the start of the year are now taking shape while still discovering better ways to do work. The end of the first quarter is a great time to review what happened in the legal tech industry and remind ourselves of the great things our community achieved. In the past two years, since the start of the pandemic in March 2020, traditional working culture and routines have remarkably changed. Many companies have embraced remote working, which many of them have initially only reluctantly accepted at first. In a 2021 report from Microsoft’s Work Trend Index, they found that 66% of employers around the world are changing their workforce strategies to accommodate hybrid work arrangements. Virtual Conferences The success of virtual gatherings and events despite the connection challenges has been revolutionary. As the initial flurry of conferences was cancelled in 2020, in 2021 we saw companies, small businesses, contractors, and everyone in between meet in newly reconfigured virtual events that otherwise would not be possible if attempted face to face. In a time when technology is our tool of choice to connect with each other, and as streaming gains popularity, these events gave us a chance to catch up and to plan ahead in a new way and with the perspective of more of our colleagues: Legalweek(year) - As one of the biggest legal technology events of 2021, ALM transformed this annual event into a truly annual event: Legalweek(year). This innovative conference consisted of a series of five interactive virtual events held throughout the year, each of which focused on different changes in the legal landscape. ILTACON - Held annually by the International Legal Technology Association (ILTA), the 4 ILTACON was held as a hybrid event, with both virtual and in-person events where attendees were able to join sessions on topics such as hybrid working environments, talent development, and maximizing productivity in uncertain times. CLOC Global Institute - CLOC provided a virtual experience for four days with engaging live Q&A with industry leaders and experts, dedicated executive programming, and events planned to “disrupt the business of law”. World Technology Law Conference – For the 49th consecutive year the event ran from June 8, 2021 - June 10, 2021. A networking event where goers were able to interact through interactive workshops, virtual breakout tables, multiple groups, and a chance to jump into different conversations. Legal Geek attendees are diverse individuals from corporate law departments, law firms, private investors and regulators. Legal Tech Growth The legal technology industry is flourishing with innovative ideas. The increasing popularity of Software as an Application products (SaaS), paired with the distinctive digital demands brought by COVID-19 restrictions pushed this insular industry into finally adopting new legal technologies. Law departments have seen great opportunities for more tech funding. Last year, several legal tech companies went public to support the growth of their team's expansion, enter global markets, and upgrade and improve their products. LegalZoom’s IPO share price spiked almost 40% on the first day of its trading and DISCO’s price also increased by 28% on IPO day. Similarly, we should celebrate Everlaw and Clio joining the ranks of legal technology companies in "unicorn status" by being valued at over $1 billion. As law firms and in-house legal teams continue to seek new ways to improve, we see that tech adoption among legal professionals is still in its early days. Regulations As a consequence of the growing reliance on a remote working model, more information is at risk and we have seen cybercrimes increase. Attackers have identified and capitalized on early vulnerability as businesses scrambled to get enough secure devices out to their workforce. In a 2021 CheckPoint Research on cybersecurity, the average weekly number of ransomware attacks increased 93% over the past 12 months. In another report, the average cost of data losses reached $4.24 million per incident in 2020, which is the highest in 17 years. To combat the growing number of concerns, stringent regulations have emerged. In the state of California, the groundbreaking California Consumer Privacy Act (CCPA) has been amended by California Governor Gavin Newsom to the California Privacy Rights Act (CPRA), which will be effective starting January 1, 2023, with a 12-month look-back period. Following in its steps, the Virginia Consumer Data Protection Act (VCDPA) was signed into law by Governor Ralph Northam on March 2, 2021, which made Virginia the second state to have consumer privacy and data security law. Not long after, the Colorado Privacy Act (CPA) was signed into law by Gov. Jared Polis. Globally, the General Data Protection Regulation (GDPR) continues to influence how data protection laws, extending their reach to include Canada, New Zealand, Brazil, India, Singapore, Thailand, and China, which are in the process of defining their own privacy laws. Reflecting on our community’s important events from the last year provides a glimpse into how far we have come and of what is yet to come. We have learned from the past two years that the legal industry is resilient and adaptable to changes. Moving forward into 2022 may be full of unexpected challenges, but we believe it is those opportunities that give birth to innovation and ingenuity that the legal industry is known for.
